Intellectual Property & DMCA Policy

This Intellectual Property & DMCA Policy (“Policy”) explains how Filipina Matchmaker (“the Platform,” “we,” “us”) addresses copyright, trademark, rights of publicity, and other intellectual property (“IP”) issues across all jurisdictions. This Policy forms part of and is incorporated into our Terms of Service. By using the Platform, you agree to this Policy.
1) User Content & License
1.1 Ownership. You retain ownership of content you create and upload.
1.2 License to the Platform. By submitting content, you grant Filipina Matchmaker a worldwide, royalty-free, non-exclusive, transferable, and sub-licensable license to host, store, use, display, reproduce, adapt, modify, publish, translate, create derivative works from, and distribute such content solely to operate, provide, promote, and improve the Platform (including safety/fraud detection, backups, and reformatting for display). Any promotional use of your content outside the Platform will respect your privacy settings and applicable consent requirements.
1.3 Your Warranties. You represent and warrant that: (a) you own or control the necessary rights in your content; (b) your content does not infringe any third-party IP or other rights (including rights of publicity or privacy for identifiable persons); and (c) your content complies with applicable law and our policies.
1.4 Moral Rights. To the extent permitted by law, you waive and/or agree not to assert any moral rights against the Platform for the limited purposes in 1.2.
2) Respect for IP (Prohibited Infringement)
You must not upload, post, or share content that infringes third-party rights, including:
- Unauthorized use of copyrighted photos, videos, music, text, or software;
- Misuse of trademarks, service marks, logos, or trade dress (likelihood of confusion, dilution, or passing-off);
- Use of someone’s name, image, or likeness without permission (rights of publicity);
- Distribution of counterfeit or pirated materials.
We may remove or restrict access to any alleged infringing material and may suspend or terminate accounts.
3) Global Notice-and-Action (All Regions)
3.1 How to notify us. Rights holders (or authorized agents) may submit an IP complaint to support@filipinamatchmaker.com.
3.2 Minimum information required.
- Your full name, role (owner/agent), and contact details (email and, if applicable, phone).
- Identification of the work/mark/right claimed to be infringed (e.g., copyright registration no., trademark registration/jurisdiction, or a clear ownership explanation).
- The exact URL(s) or precise location(s) on the Platform of the material to be removed/disabled.
- A statement of good-faith belief that the use is not authorized by the rights holder, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury (where applicable), that you are the owner or authorized to act for the owner.
- A physical or electronic signature (typed full name is acceptable for email submissions).
3.3 Language. Notices should be in English to ensure prompt handling (we may request translations where needed).
3.4 Our actions. We act expeditiously to remove/disable access to allegedly infringing material upon receipt of a sufficiently detailed, valid notice and we may notify the uploader.
4) Additional Requirements Under U.S. DMCA (17 U.S.C. §512)
4.1 Designated DMCA Agent (contact).

4.2 Standard Technical Measures. We accommodate and do not interfere with standard technical measures that are widely used by copyright owners to identify or protect copyrighted works (DMCA §512(i)).
4.3 Counter-Notification. If you believe your content was removed in error or misidentification, you may send a counter-notice to support@filipinamatchmaker.com that includes:
- Identification of the material removed and its prior location (URL);
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
- Your name, address, and telephone number;
- Your consent to the jurisdiction of the U.S. federal district courts for any judicial district in which the Platform may be found, and that you will accept service of process from the complaining party (or its agent);
- Your physical or electronic signature.
4.4 Restoration Window. Upon receiving a compliant counter-notice, we will forward it to the complainant. Unless we receive notice that the complainant has filed court action seeking to restrain you, we may restore the material not less than 10 and not more than 14 business days after we forward the counter-notice.
4.5 Misrepresentation. Parties who knowingly submit false notices or counter-notices may be liable for damages under DMCA §512(f).
5) Trademarks & Other Rights (Global)
5.1 Trademark complaints should include: the mark, registration number and jurisdiction (or basis for unregistered rights), goods/services, and the exact infringing use/URL(s) on the Platform.
5.2 Rights of publicity/privacy complaints should include evidence of identity and lack of consent.
5.3 We may request additional information to verify claims and will remove/disable access where appropriate.
6) Repeat Infringer Policy
6.1 We maintain and reasonably implement a policy for termination of users who are repeat infringers. Multiple valid notices against a user (or clear patterns of infringement) may result in permanent account termination.
6.2 We may also apply technical measures to deter repeat infringement and will consider counter-notice outcomes when assessing strikes.
7) Platform Discretion & No General Monitoring
7.1 We may remove or disable access to any content alleged to infringe without prior notice and may suspend or terminate accounts at our reasonable discretion.
7.2 We do not undertake a general obligation to monitor all content; however, we may use automated and human review tools to detect obvious violations and to comply with applicable law.
8) Preservation & Disclosure
We may preserve notices, counter-notices, and related account information and may disclose them to involved parties or competent authorities as required by law or to protect our rights, users, and the public.
9) International Frameworks & Conflicts
This Policy is designed to comply with the U.S. DMCA, the EU Digital Services Act and related copyright rules, the UK Online Safety/notice-and-takedown regime, and analogous laws worldwide. Where stricter local rules apply, those rules shall govern for affected users and content.
10) Updates
We may update this Policy to reflect changes in law, technology, or our procedures. The “Effective Date” will be updated accordingly. Continued use of the Platform after notice constitutes acceptance.
