Jurisdiction & Dispute Resolution Terms

These Jurisdiction & Dispute Resolution Terms (“Terms”) govern how disputes between you (“User”) and Filipina Matchmaker (“we,” “us,” or “the Platform”) are resolved. By using the Platform, you agree to these Terms.


1. Governing Law

1.1 Global Scope. These Terms are intended to be enforceable worldwide.
1.2 Primary Governing Law. Unless prohibited by local mandatory law, these Terms shall be governed by and construed under the laws of:

  • England and Wales (common law jurisdiction, globally recognized),
  • Supplemented, where applicable, by international principles such as the United Nations Convention on the Use of Electronic Communications in International Contracts (2005).

1.3 Consumer Protection Laws. Where local consumer protection or mandatory statutory rights apply (e.g., EU, UK, Australia, Canada, Philippines, US state law), those rights remain unaffected.


2. Dispute Resolution Framework

2.1 Good Faith Negotiation. Parties agree to attempt to resolve disputes informally in good faith before pursuing formal proceedings.
2.2 Mediation. If negotiation fails, disputes may first be referred to mediation under rules such as:

  • Singapore Convention on Mediation (2019), or
  • Local accredited mediation bodies where enforceable.

2.3 Arbitration. If mediation fails, disputes shall be resolved by binding arbitration, administered by:

  • International Chamber of Commerce (ICC), or
  • London Court of International Arbitration (LCIA),
  • Or a comparable institution in the User’s jurisdiction, if required by law.

2.4 Arbitration Rules. Unless otherwise required, arbitration will be conducted under ICC Rules, by one arbitrator, in English, with electronic/remote hearings permitted.

2.5 Arbitration Venue. Default seat of arbitration shall be London, England, unless prohibited by applicable law.

2.6 Costs. Each party bears its own costs unless the tribunal orders otherwise.


3. Class Action & Jury Trial Waiver

3.1 Class Actions. To the fullest extent permitted by law, disputes must be resolved on an individual basis and not as part of a class, consolidated, or representative action.
3.2 Jury Waiver. Where jury trials are available (e.g., United States), users waive the right to a jury trial, except where such waivers are unenforceable.


4. Small Claims Option

4.1 Users may bring claims in small claims court (or the local equivalent) in their jurisdiction, provided the matter qualifies and remains within the monetary limits of that court.


5. Injunctive Relief

5.1 Nothing prevents either party from seeking injunctive or equitable relief (e.g., protection of intellectual property, safety/security concerns) in any competent court.


6. Severability

6.1 If any portion of these Terms is held unenforceable in a jurisdiction, the remaining provisions shall continue in full force and effect.


7. Changes to This Policy

We may update these Terms to comply with evolving global legal standards. Substantive changes will be communicated to users in advance.
